The Seminole Wars U. S. History 1301. 046 Carissa Farley Professor Rumanuk April 3, 2013 The Seminole Wars was one of many wars fought during our nation’s history. Some of the wars in our history were fought over Indian Removal. According to Ron Soodalter, â€Å"The Second Seminole War erupted over broken treaties that repeatedly changed the boundaries of the Seminole reservation and finally sought to push the Seminoles out of Florida altogether†.That sounds a little harsh to try and control the land of the Indian tribes. However that is just the way things were back then. Back then the Indians were considered one of the United States biggest enemies. â€Å"The U. S Army and the Seminoles fought three wars between 1816 and 1858. † One of these wars that were fought was the Second Seminole War. The war was fought for seven years. But the Second Seminole War, fought from 1835-1842 cost upward of 530 million-more than the annual federal budget at the time-and resul ted in the deaths of nearly 1,500 soldiers (mostly from disease), the forced removal from Florida of between 3,000 and 4,000 Seminoles, and the deaths of countless others. † Some wonder why all these deaths happened and it all comes down to the military strategy and stopping the spread of disease. There were people who opposed the relocation of the Seminole Indians. Two important people that opposed the relocation were two Seminole chiefs named Osceola and Micanopy.They both planned the effort against relocation but were defeated by a U. S commander by the name of Thomas Sidney Jesup. Jesup’s tactics wore down the Seminoles and in the end helped the United States drive the Seminoles out of Florida. The people who didn’t oppose the removal of Indians included President Andrew Jackson, Zachary Taylor, Thomas Jesup, Duncan Clinch, and most of the United States. The war was started due to a â€Å"conflict that was the direct result of the nation’s unbridled d esire for territorial expansion, and of President Andrew Jackson’s Indian removal policy. According to the constitution of the United States all men are created equal. So shouldn’t that include Indians? Seeing as how we are treating them as the enemy, I don’t think that the Indians were included as part of the all men are created equal line of the constitution. However some people would say that the Indians are the enemy and should be treated horribly. â€Å"Jackson believed Indians posed a threat to the peace and tranquility of the American nation and should be relocated or eliminated.He formalized his policy in 1830, selling his concept to Congress, which passed the Indian Removal Act by the narrowest of margins. Over the next few years Jackson continued his campaign to remove the â€Å"Five Civilized Tribes†- the Cherokee, Chickasaw, Choctaw, Creek, and Seminole- and drive them west of the Mississippi. † The Indians were divided in what to do. S ome chose to use non-violence while others decided to go to the Supreme Courts and let the Courts decide what to do. The courts ruled in favor of the Indians and that caused a problem for Georgia.Georgia went to Jackson and Jackson told Georgia to ignore the ruling. Georgia and Jackson decided to ignore the court’s ruling. Because of this the Cherokee Indians were removed in an event called the Trail of Tears. In 1834 Jackson had his sights set on Florida and the Seminoles. â€Å"Eleven years earlier the Treaty of Moultrie Creek had directed the Seminoles to surrender all land claims in the territory and move to a 4-million-acre reservation in central Florida. It also bound them to remain peaceful and to apprehend all runaway black slaves and other fugitives for the government.For its part the government would provide cattle and hogs, an animal annuity of $5,000, an interpreter, a blacksmith, and an Indian agent, and keep all whites from encroaching on Indian Land- the latte r an unenforceable provision. The agreement came with a 20-year shelf life. † Unfortunately Jackson broke the agreement and signed another agreement that would force the Seminoles to move to the Arkansas territory within a three year period and surrender all black runaway slaves. I feel like this is violating laws. It is violating treaty laws but making a previous treaty not being upheld.On the other hand it makes the United States gain more land. I don’t agree with President Jackson’s way of removing Indians and taking all the slaves back but to be fair â€Å"Jackson harbored a personal resentment towards the Seminoles for their practice of sheltering and adopting runaway slaves into the tribe. † However his resentment is violating a person’s right to having the freedom to make their own decisions. â€Å"According to several Army officers present at the treaty negotiations, the Indians had been â€Å"wheedled and bullied into signing†Ã¢â‚¬ . The government tried to justify why they did what they did to the Indians ut the truth is they violated civil freedoms. A turning point in the war happened in late 1835 when â€Å"the hawkish Seminoles judged one chief who had agreed to relocate one traitor to the tribe, and Osceola killed him. It soon became clear war would come-and soon. † Unfortunately Osceola killed the Indian agent on December 28 and anyone in the cabin. He then took treasure from the agent’s cabin. To me this looks like Osceola is out for blood but he isn’t. He is trying to protect his tribe from suffering having to move away from their homes. The agent’s death was avenged by Jesup.Osceola died from Malaria in prison. The war went on in a bloody fashion until it was finally ended by all of the Seminoles going to Arkansas and Florida being given to the United States. Jackson’s prejudice towards the Indians didn’t help. â€Å"In the midst of the War of 1812, Jackson, then in charge of the Tennessee militia, was sent into southern Alabama, where he ruthlessly put down an uprising of Creek Indians. The Creeks soon ceded two-thirds of their land to the United States. Jackson later routed bands of Seminoles from their sanctuaries in Spanish owned Florida. Ethical Treatment of Prisoners Essay

Some people believe the history of corrections shows continuous movement toward more humane treatment of prisoners as society has progressed. In the beginning punishments for prisoners were considered a corporal punishment which was whipping, beheading, dismembering, torture or even death. There was fines, dispersion of property were common which was more common than the physical torture. Execution was the economic and corporal punishment as the estate was forfeited. The economic and physical sanctions have given way of imprisonment less depreciation in the liberty of parole and probation. When there are thousands of crimes incarcerated throughout the United States, the ethical treatment of prisoner’s rights must be analyzed. Throughout the years many modifications have been made to accommodate inmates and preserve their basic human rights. Have we as a society done enough regarding the ethical treatment of prisoners or have we made their lives in prison too easy that it is no longer a punishment for them? There are many people in the United States who have strong feelings of what is right and wrong and fall on both sides of this question. Utilitarianism is the belief that moral rules should be choices made by a society to promote the happiness of its members Mosser (2010). Through the utilitarian view the argument could be made that these prisoners are being treated to good and not good enough. Utilitarianism gives an understandable, theoretical foundation for moral decision making. Prior to coming to a decision upon a course of action, the utilitarian is asked to consider its effects on the entire population over an infinite period of time Mosser (2010). One problem with this method of decision-making is that many people might not agree with the premise that maximization of happiness should be the basis for morality. An example of this is an eye for an eye; if you kill someone in my family then I will have your life. In earlier history like the cowboy era this is how criminals were treated. Now, this is no longer accepted in our society. Our society’s ethical values have changed. For hundreds of years, prisoners had no rights. That is until 1909 when the Georgia Supreme Court ruled that although convicts have lost their freedom; they do have civil rights Davenport (2009). During this era, institutions were legally immune in state and federal courts from lawsuits, also called the hands-off doctrine, wardens ran their facilities as they felt necessary and were not held accountable for the conditions that existed in their facility Davenport (2009). Prisoners were beaten regularly and denied the basics such as food, medical care, and protection from staff or other inmates. These types of incidents continued for many of years. In the 1960’s several legal avenues opened for prisoners. Prisoners would now have the ability to have their grievances heard in state and federal courts. One of the major changes that enabled this is the cruel and unusual punishment clause of the Eighth Amendment; another is the civil rights provisions of Section 1983 of Title 42 of the U. S. Code Davenport (2009). The Eighth Amendment asserts that excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishment inflicted Davenport (2009). The cruel and unusual punishment clause was not intended for prisoners; rather the focus was on punishment outside the law. The clause also did not apply to state prisoners. The Supreme Court heard very few cases in this era. In the 1960’s, the Supreme Court began to incorporate the Bill of Rights to state laws. This meant the cruel and unusual punishment clause now included prisons and prisoners. Prisoner’s then began to file suits to change the way prisons operated, citing cruel and unusual punishment, inadequate healthcare, demanding more access to courts and due process. People who are employed in the justice system have to exhibit strength of mind and body to prove they are worthy to be in charge of those who may be a danger to society. This fact alone places these individuals in a position of power, and without a personal and professional code of ethics to live by; this power could be taken out of context. This could lead to damage within the system, as well as out on the street. For these people must make moral decisions everyday. A personal set of ethics can often be hard to define. Ethics are not on a person’s mind as they make various choices throughout the day. When a person sub-consciously makes one judgment or another, they are not aware that ethics plays a role in the decisions that are made. In examining ethical egoism and utilitarianism my personal view is definitely closer to utilitarianism than ethical egoism. Utilitarianism is an exceedingly, even extremely demanding moral view for most people. If we have a duty to always bring about the best outcome, than any time we can increase the well-being of others, we have a moral duty to do so. I believe it is morally better to help the most people at a time than to serve the self interest of one person. The thousands of crimes incarcerated throughout the United States had their day in court and are now housed in a penal institution to serve out their sentence. As a society we have passed ethical laws to protect the prisoners against harm from others and to make sure they are treated with respect. Through the eyes of utilitarianism arguments are made that these prisoners are being treated to good by some and not good enough by others. Regardless of which theories or ethical beliefs a person chooses to believe in they must follow the law or they could end up as a prisoner in the United States. Those in the justice system sworn to protect prisoners can not choose to follow their own beliefs but they must follow the laws and regulation set forth before them. Ethics as a form of intellectual inquiry does not provide answers to moral questions. People with beliefs about right and wrong do. Societies are built upon those beliefs. As we have analyzed the ethical treatment of prisoners with theories of ethics we can argue that society’s views of right and wrong coincide with reality, are representative of the objective moral order, and encompass the will of the people with regards to their treatment. The these two articles both tackle the future of the Euro – and attempt to assess the issues involved and the odds of success. The first article, by Timothy Garton Ash, outlines the history of riots and dissatisfaction that have erupted in the European Union since the beginning of this financial crisis, then goes on to outline the steps that would be necessary for preserving the European Union. It is important to note that this article is from the end of last year, and many things have happened in the interim, but essentially the issues stay the same, which is that the relationship between the EU’s poorer and richer countries is fraying. Krugman’s article indicates that the fall of the Euro, and possibly the EU, is imminent, and he faults failed economic policy, as well as the fundamental nature of the EU, as the problem. Interesting ly, both of these articles come from and espouse a liberal perspective, though in very different, and somewhat contradictory, ways. Krugman’s article faults conservative measures, such as budget cuts and austerity, for the depression’s continuance, but dislikes the EU as a structure, while Ash treats the large, overarching government of the EU as a good thing. The ideological spin of the Krugman article is inherently liberal, especially in his visceral attacks on austerity measures. He indicates that any good economist could have indicated (and did indicate) that austerity measures would lead to a depression (Krugman). This is a fundamentally liberal perspective, as it calls for higher government spending. Conservatives would argue that the deficit explosion is too much to handle, and that the Greece and other country’s addiction to debt is the fundamental issue, and that the austerity measures are the only method of stopping the explosion of such debt to unmana geable proportions. Ash’s article also takes a liberal perspective, in most ways. Firstly, it inherently treats the large government of the EU, with some centralized authority and one of the most byzantine bureaucracies on the planet, as good thing, talking about how it should be â€Å"saved† and the methods in place to do so. A conservative would likely be for smaller government, and find the dissolution of the European Union not at all problematic. He focuses much more than Krugman on the political situation on the ground, observing that the German declaration that funds going to Greece must come with â€Å"government oversight† (from Germany), and how Greeks with a national memory of the Second World War find that troubling (Ash). Liberal ideologies are present in both of these articles, but in two different ways. Kruger demonstrates socio-economic liberalism, seeing large government spending as a good thing, while Ash sees large governments as inherently goo d and worth saving (something that Kruger disagrees with, calling the Euro a â€Å"failed experiment†). Though conservatives talking about these issues might have some good points – for instance, that it irresponsible for a country as small as Greece to drive up debts that are unmanageable in order to provide social programming. Known for Caribbean pastoral imagery in his writing (Jennings 4), Roach paints vivid pictures that show beauty of the land. In each stanza of the poem, the poet conveys his adoration of the land. The poem opens with sensual imagery which allows the reader to picture lush green vegetation and hear waves breaking amid the expansive blue waters. Roach further enjoys what the land has to offer by accompanying others on a jubilant banana boat tour. Roach's imaginative perception of the landscape serves a dual purpose; it captures the essence of Caribbean beauty and showcases the delight that the author takes in his land. Amid the beauty in each stanza, however, resides negativity and inner turmoil. Roach reveals that the internal conflict interrupts his ability to fully appreciate his surroundings. In the first stanza, the beauty and brilliance of the landscape intrudes upon his desires. Though pleasing to the eye, Roach's surroundings hold his dreams and aspirations hostage. From there, the poem digresses into an explanation of the role of restriction and how it ultimately tainted his view of the land. With songs in his heart, Roach once again optimistically attempts to enjoy what the land has to offer in the following stanza. However, the enjoyable excursion is short-lived as the sun turns to snow and they encounter "hostile and exploding zones." Thus, inner turmoil and confusion taints the joys and hopes presented in the poem. Each stanza of the poem conveys an absolute contrast between the land and the Roach's state of mind. In the beginning of the poem, the distant beautiful and crashing waves are empty, yet they engulf all of his dreams. It seems that the water represents a destructive force. Roach comments on the burial of his friend and his sister's beauty being tainted. Obviously, the vicious experiences take a toll on the people of the land. In spite of it all, however, the people remain steadfast in their desire to survive. Once again, hope is presented in the people's perseverance to regenerate their confidence. Moreover, the people's perseverance encourages Roach to proclaim that love (the pride in their heritage and nation) defeats the oppressive struggle. Some countries can spend a great amount of money on their health care (such as the United States) but still might not have the best health care in the world. Others have special arrangements that new mothers and infants can go through to make sure that they start off their life in a good and healthy environment. In this paper I am going to compare and contrast the infant health care and the overall prenatal care in the United States and South Korea by referencing multiple articles and textbooks that focus on this subject. Both countries have various ways in which they handle their health system and the care of their newborns. There are many factors that determine the health of a newborn such as the nutrition that the soon to be mother consumes, the environment that the mother and the child live in, and the hospital that the child is born in. Throughout the years each of these countries have been putting time and money into their health system with the goal of having the most outstanding health care system in the world. Their progress can be recorded in many different ways which will be discussed within this paper. Also the United States and South Korea both have very different systems when dealing with prenatal and infant care. One way that the infant care of a country is measured is through the mortality rate of the infants. There are reasons for the high mortality rate, such as the fact there are many different races, ethnicities, and social statuses within the United States. Race and ethnicity do have an input in a person’s health and their life style. Some races (such as Asians) have a higher life expectancy and a lower mortality rate throughout their race because of the way that they are raised and the traditions that they fallow. The social statuses of the expecting mothers also have an impact on the future children because when the parent is part of a higher social status, it is assumed that they have a higher level of education and therefore know more about how they should care for themselves and their infants. The opposite goes for people who are part of a lower social status. The United States has been lowering the number of infant mortality rates by putting programs in affect to try and help out the health system. This number is high for premature births and these programs that are being put into place should help lower it. Even with all of these programs working toward a better health system, South Korea has less of an infant mortality rate. South Korea has improved its health system throughout the years and it has shown in their child care. There are also more programs that are scheduled to appear throughout the fallowing years. Many pregnant women from all over the world come to South Korea just to get this treatment after they give birth. However, this facility is expensive, so not everyone can afford this luxury. According to Yeon-soo (2013), â€Å"The cost of using an upscale sanhujoriwon is 5 million (4,730 U.  S. dollars) to 10 million won (9,460 dollars) for a two-week stay, but the facility is so popular that a reservation might not be possible if not made six to seven months prior to childbirth† (para. 4). That is the price for the most expensive and luxurious places; other places can be thousands of dollars cheaper. In these facilities the nurses make sure that the patients get the right exercise (such as light yoga) and eat the correct food so that their recovery after birth will be as pleasant and beneficial as possible. They also care for the newborn and make sure that they get the nutrients that they need in the first couple of weeks. This helps out the new mother because they have time to relax and recover while their baby is getting the necessary care that is needed. When the mother is ready to go home after a couple of weeks they have a better time adjusting to their new life with a baby because they had the rest and help that they needed. In the United States they do not have these same accommodations but they to do have systems to help out the new mother. The United States has many medical professionals to help with neonatal and postnatal care. Usually after a mother gives birth (depending on the birthing method), the mother will stay at the hospital for a couple of days, and then return home. While at the hospital the nurses will help the mother with nursing, feeding, and changing the child. They will also make sure that the mother is recovering well after the birthing process. Both in the United States and in South Korea, they have programs to help mothers and infants after birth. However, the system in South Korea is more advanced because it keeps the mother and infants for a longer period of time which is more beneficial to their health. Nutrition to a pregnant women is a very important factor. If the mother does not get the correct nutrition than they are putting themselves at risks for multiple diseases. Also they are not only putting themselves at risk but they are also putting their unborn baby at risk. Some diseases that the mother can catch from bad nutrition are gestational diabetes, gestational hyptertension, and preeclampsia. Gestational diabetes when not looked after turns into gestational hyptertension; the worst out of the three that were mentioned is preeclampsia. This is because (Sizer Whitney, 2011), â€Å"Preeclampsia affects almost all of the mother’s organs—the circulatory system, liver, kidneys, and brain† (p. 508). If all of these organs are affected than the baby is at a serious risk of getting hurt. Most of these diseases will disappear after giving birth, but it raises the risk for the mother to catch another serious disease, such as type two diabetes. When a pregnant women is diagnosed with having gestational diabetes they are more likely to catch type two diabetes later on in life. It might not be right away but it could happen a couple of years later. Also they are more likely to be diagnosed with gestational diabetes again if they ever become pregnant again. Being overweight and pregnant is a big risk during pregnancy. This could also explained for the high mortality rate in the United States since they have a higher rate of obesity and it is difficult to label a child as premature and unhealthy if they are at a healthy weight. The environment that the pregnant women is living in is very crucial to her and her unborn child’s health. There are many illnesses that a woman can pass on to her child from environments that are hazards. When a mother is in her embryonic stage her baby is at a point of rapid development. This is a very crucial stage because the baby is starting to grow their organs, however they are also more likely to catch a disease which could cause a deformity during this stage. If the mother catches a disease than they are more likely during this stage to pass it to their baby which could cause a miscarriage or deformities. The issue of the environment is more of a problem for South Korea because of all the pollution that is in the air. South Korea is a very overpopulated country (especially in Seoul) and with all the cars and factories the air gets easily polluted. This is also an issue in some part of the United States, but it depends on where the person lives. However, in South Korea many pregnant women are exposed to polluted air for most of their pregnancy and some of their babies are born with serious skin pro blems. There is air pollution everywhere a pregnant women goes but if the pollution is high than they are putting the baby more at risk. There are many factors that play into the prenatal and postnatal health. South Korea and the United States both work hard to make their health system the best that it can be. They have many programs in place and many more programs to come in the future. They are working on their hospitals to make sure they are as convenient as possible so that the mothers and newborns can have the best possible health care. Both countries are working towards lowering their mortality rate and lessening the amount of premature and low-birth-weight children. There is also the nutrition and the environment that the mother is exposed too. A simple factor as being obese can cause serious damage to the mother and the unborn child. Many expecting mothers do not understand that concept so they do not see the risk in it. Of course one country has a better health care system then the other, however they both have pros and cons to their countries. The United States has more funds to deal with and has more medical professionals working in their hospitals so that their patients can receive the best care possible. The negative aspect of the United States is that they have a high obesity rate and a high mortality rate. They also need to work on more programs to lower their mortality rate so that they can have the best possible health care. South Korea has excellent postnatal care, which many people around the world want to experience and be a part of. Also they have a low level of obesity so they are not as likely as the United States to get the diseases that come along with being overweight. The negative aspect of Korea is that their environment is not the best because of the pollution that is surrounding the air. South Korea is an overpopulated country so the air is filled with pollutants that are not good for a pregnant woman and can cause low-birth weight and birth defects. Overall both countries have areas in their health care system that they have to work on and areas outside of their health care system that they need to address. Justification of the Study Intensive trauma care of pediatric patients is faced with many issues such as quality of care, efficiency and cost-effectiveness. Scoring systems such as the Pediatric Trauma Score can aid in clinical decision making through objective measurement of severity of illness in relation to a particular outcome such as mortality or morbidity. In particular, scoring systems have become the standard for intensive care unit outcome and efficiency benchmarking. Furthermore, there is considerable difference between clinicians prognostication estimates. Early identification of patients with high probability of mortality can help families with difficult decisions, prevent unnecessary suffering and help direct limited resources to a more practical use. The PTS consists of six variables. Each variable is scored +2 for minimal or no injury, +1 for minor or potentially major injury, or -1 for major or life-threatening injury. The total score ranges from +12 to -6 with increasing severity.3 Scoring systems such as the Pediatric Trauma Score can aid in clinical decision making through objective measurement of severity of illness in relation to a particular outcome such as mortality or morbidity.4 Several studies revealed consistently the direct linear relationship between Pediatric Trauma Score and injury severity thereby confirming that P.T.S. is an effective predictor of both severity of injury and potential for mortality.5 REVIEW OF RELATED LITERATURE Most of the scoring systems are not appropriate for pediatric trauma patients. Variables such as respiratory rate, heart rate, and systolic blood pressure differ with infancy and childhood. In addition, the verbal response as used in GCS is not applicable for young children. For these reasons, Tepas and colleagues3 created the Pediatric Trauma Score (PTS). The authors stated that weight becomes a variable because pediatric patients had fewer physiologic reserve. Systolic blood pressure, patency of airway, level of consciousness, presence of wounds or fractures were variables included. 3 The presence of these injuries suggests severe energy transfer and positively correlates with concomitant visceral injury.10 Below is the Pediatric Trauma Score. In a study by Tepas, three categories of patients with probability of mortality were identified. Pediatric trauma score of greater than 8 had a 0% mortality while pediatric trauma score between 0 and 8 had an increasing mortality related to their decreasing pediatric trauma score. Score of less than 0 had 100% mortality. This study documented the direct linear relationship between Pediatric Trauma Score and injury severity validating that P.T.S. is an effective predictor of both severity of injury and risk for mortality.5 Consistent with the findings of the latter, Ramenonofsky compared the evaluation of pediatric trauma patients by paramedic in the field versus the physician in the emergency room using the Pediatric Trauma Score. There was agreement between the scores of these two individuals 93.6% of the time, correlation coefficient 0.991, r2 = 0.982. The sensitivity and specificity of Pediatric Trauma Score was computed at 95.8% and 98.6%, respectively. He described Pediatric Tra uma Scoring System as a straightforward modality for assessing the severity of injury.6 Eichelberge examined the applicability of the PTS found significant correlations with survival, Injury Severity Score (ISS) and mortality. 8 On the other hand, the use of PTS as a predictor of mortality was found to be inadequate in a retrospective study by Balik. Size classification was noted to be overemphasized because of the low mortality (7.7%) in children less than 10 kg. Forty-nine of 71 surgically treated patients with intra-abdominal organ injuries had a PTS >8. The existing variables of PTS did not have equal relationships to mortality.7 Critics have also noted that the PTS suffers from scoring ambiguity leading to misinterpretation and inadequate scoring.11 Problem also arises due to a systematic bias in scoring. For example, the assessment of a patient’s consciousness can be done at the scene or on admission to the emergency department. 12 Despite exhaustive review of the literature on Pediatric Trauma Scoring, there has been no mention of the predictive value of Pediatric Trauma Scoring done on patients upon entry to an ICU. Conclusion of studies on Pediatric Trauma Score may be less generalizable due to possible variability in settings.9 RESEARCH QUESTION Among pediatric trauma patients admitted to Centralized Surgical Intensive Care Unit in Davao Regional Hospital, what is the relationship of outcome of patients to pediatric trauma score using a retrospective cohort study? SIGNIFICANCE OF THE STUDY Investigating the reliability of Pediatric Trauma Scoring system in predicting mortality and prolonged hospital stay is important. The results of this study can be a validation of earlier studies made on this scoring system as a tool in objective measurement of severity of illness as well as an intensive care unit outcome and efficiency benchmarking. SETTING This study will be conducted in Davao Regional Hospital (DRH), a tertiary hospital with 250-bed capacity, in Tagum City. The Centralized Surgical Intensive Care Unit (CENSICU) is an intensive care unit for adult and pediatric surgical patients in Davao Regional Hospital. The Department of Surgery of Davao Regional Hospital is a member of the Mindanao Integrated Surgical Residency Training Program under the Department of Health, Region XI. PARTICIPANTS All pediatric trauma patients admitted to CENSICU in Davao Regional Hospital between January 1, 2013 to December 31, 2013 will be retrospectively included in the study.
